Terms of Service

These terms are the agreement between you and ASM Labs for the use of Roznamcha: Attendance & Salary (formerly Attendance Manager). By creating an account or using the app, you accept them. If you do not accept them, please do not use the service.

1. Who we are

Roznamcha is operated by ASM Labs, a sole proprietorship of Agam Singh Madaan, based in India. Contact: roznamcha@asmlabs.in.

2. Who may use it

• You must be at least 18 years old.
• If you use the app for a business, you confirm you are authorised to accept these terms for that business.
• The service is business software for recording staff attendance and payroll.

3. Your account

• Keep your sign-in secure. You are responsible for activity under your account.
• The person who creates an organisation is its owner and controls who else has access and what they can do.
• Tell us promptly at roznamcha@asmlabs.in if you believe someone has gained access to your account.

4. Your responsibilities for employee records

This is the most important clause in these terms, because the app holds records about people who are not you.

• You decide what to record about your employees. You are the data fiduciary for those records and we process them on your instructions.
• You are responsible for having a lawful basis to record them, for informing your employees as the law requires, and for keeping the records accurate.
• You must not record anything the law forbids you to record, and you must not use the app to monitor people unlawfully.
• If an employee asks you to correct or delete their records, that request is yours to answer. We will help where we reasonably can.

5. Acceptable use

You agree not to:

• Break the law, or use the app to harm, harass or defraud anyone
• Attempt to reach another organisation's data, or probe, scan or interfere with the service's security
• Copy, resell or redistribute the service as your own product
• Automate access in a way that degrades the service for others

6. Plans, fees and payment

• A free plan is available with a limit on the number of active staff you may record.
• Paid plans, when offered, are purchased on our website. Prices, the staff limit and any refund terms are as shown at checkout at the time of purchase.
• Prices are in Indian rupees and exclude tax unless stated otherwise.
• Purchases are not made inside the Android app. The app has no checkout and no prices in it.

6a. What happens if a paid plan ends

When a paid plan lapses or is cancelled:

• For 3 whole days (India time), nothing changes. Grace exists for a renewal that fails for an ordinary reason — an expired mandate, a replaced card — and we never pause while your bank is still retrying the payment. We tell you in the app and by email.
• After grace, if the organisation had more active staff than the free plan allows on the day cover ended, it becomes view-only.

In view-only mode you keep:

• Every record, visible in full
• All exports, including CSV and PDF reports
• All backups: you can download any of them. Restoring a backup in place resumes when a plan is bought.

What pauses in view-only mode: marking attendance, adding, editing or removing staff, recording advances or salary payments, and restoring a backup in place.

An organisation returns to normal by buying a plan. The staff count is fixed on the day cover ended, so record anyone who has left before that day; after it the count does not change. A business that is within the free plan's limit on that day continues free.

7. Availability, backups and your own copies

• We work to keep the service available, but we do not promise uninterrupted or error-free operation. Maintenance and outages happen.
• The app makes automatic backups you can restore yourself, and the privacy policy explains how long they are kept.
• Backups are a convenience, not a guarantee. For anything you cannot afford to lose, export your data using the export features and keep your own copy.

8. Changes to the service

We improve and change the app over time. We may add, alter or withdraw features. If a change materially reduces what a paid plan provides, we will tell you before it takes effect.

9. Ending the agreement

• You may stop using the service at any time and delete your organisations and account from within the app.
• We may suspend or close an account that breaches these terms, that is used unlawfully, or that puts the service or other users at risk. Except where the breach is serious or urgent, we will contact you first and give you a chance to put it right.
• After an account is deleted, data is removed according to the retention periods in the privacy policy.

10. Our intellectual property

The application, its design and its code belong to ASM Labs. These terms give you permission to use the service, not ownership of it.

Your data remains yours. We claim no ownership of the records you enter, and we use them only to provide the service as described in the privacy policy.

11. Disclaimers

The service is provided "as is", without warranties beyond those that Indian law does not permit us to exclude.

12. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data beyond the remedies in these terms. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose, or ₹1,000 if you have paid us nothing.

Nothing here limits liability that cannot lawfully be limited, including for fraud.

13. Governing law

These terms are governed by the laws of India. The courts at Ajmer, Rajasthan have exclusive jurisdiction over any dispute arising from them.

14. Changes to these terms

We may update these terms. The date at the top shows the current version, and we will notify you in the app or by email before a significant change takes effect. Continuing to use the service after that means you accept the updated terms.
